Create a clear route from process output to accepted product.
Commercialising a co-product requires more than demonstrating that it has useful properties. Establish its classification, handling, quality, customer acceptance and lawful use. Certification of origin and environmental claims can support that pathway but do not replace product compliance. [[ Environment Protection Authority Victoria, Safe production and use of digestate guidelines ](https://www.epa.vic.gov.au/safe-production-and-use-digestate-guidelines), [ NSW Environment Protection Authority, Resource recovery framework ](https://www.epa.nsw.gov.au/Your-environment/Recycling-and-reuse/resource-recovery-framework), [ GreenPower, LCLF and Biogenic CO2 Certification announcement ](https://www.greenpower.gov.au/news-and-events/news/lclf-and-biogenic-co2-certification-announcement)]

Digestate: match quality with permitted use
Identify inputs, treatment, nutrient composition, relevant contaminants and destination. Waste-related requirements can affect transport and receiving sites without necessarily prohibiting beneficial use. Check the applicable reuse route and conditions rather than describing all digestate as an unrestricted fertiliser.
Biogenic CO₂: separate origin from purity
Food, beverage, horticultural and industrial customers may require different specifications. Establish testing, traceability, pressure/storage and supplier responsibilities. A biological origin or proposed origin certificate does not demonstrate food-grade compliance.
Biochar: qualify the input and claim
Additional conversion creates a separate product assessment. Verify process, feedstock, contaminants and intended use. Carbon-storage claims require an applicable methodology and evidence; quality certification and carbon-credit eligibility are different checks. [[ European Biochar Certificate, Biochar Guidelines ](https://www.european-biochar.org/en/certificate)]
Develop repeatable evidence
Shelby supports common testing methods, batch records, product descriptions and recognition of equivalent evidence where authorities accept it. Keep conditions relevant to local soils, biosecurity and safety. A nationally repeatable evidence package can reduce replication effort without claiming automatic cross-border approval.
International models worth assessing
England’s digestate resource framework and Sweden’s SPCR 120 scheme offer different approaches to quality and trust. Their value for Australia lies in the principles of suitable inputs, verification and defined uses - not in copying overseas approvals. Give financiers a dependable outlet
Document the market-access pathway alongside contracts and net returns. If a route remains unresolved, show the effect on storage, treatment and disposal. Support for co-product commercialisation should help resolve these interfaces early in project development.
Keep three compliance tracks and three kinds of claim separate
A useful output may remain regulated waste until its particular lawful pathway is demonstrated. Document the input, process, intended use and jurisdiction rather than assume origin establishes permission.
| Output | Compliance track | Claim requiring separate evidence |
|---|---|---|
| Digestate | Waste classification, input eligibility, testing and authorised reuse | Nutrient / fertiliser performance and customer acceptance |
| BioCO₂ | Safe handling, product quality, industrial or food / beverage requirements | Biogenic origin, impurity compliance and any environmental claim |
| Biochar | Lawful processing, product quality and permitted sale / use | Application performance, durability and carbon-accounting eligibility |
NSW resource recovery orders and exemptions have specific material and use conditions; identify both the supplier's duties and the user's conditions. Victoria offers conditional digestate pathways with input and quality requirements, not blanket permission for every digestate. Confirm current regulator documents for the actual operation before sale or land application.
England's end-of-waste framework and Sweden's SPCR 120 can inform quality-system questions. They are international comparisons, not Australian permissions or substitutes for state rules. Renewable-origin certification does not establish food grade, safe nutrient application or permanent carbon removal.
Keep a dated compliance file with test methods, sample periods, applicable documents, customer acceptance, handling responsibilities and unresolved conditions. Proposed harmonisation in Shelby's submission remains advocacy; do not present a future product rule as enacted law.

Frequently asked questions
Does waste classification automatically prevent sale?
No. The lawful handling and reuse route determines the requirements and practical costs.
Can one approval apply across all states?
Do not assume so. Check recognition and requirements in each destination jurisdiction.
Does CO₂ origin certification replace purity tests?
No. Origin, customer quality and permitted environmental claims are separate.

Digestate is pre-classified as reportable priority waste. Conditional pathways require compliance with the actual determination.
